Terms of Service for EXASPERATION

Welcome to EXASPERATION. These Terms of Service (“Terms”) apply when you access our website, create an account, purchase a product or use our services. By using our website or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our website. Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded.

1. Eligibility and acceptance

By using our website, you confirm that:

• You are at least 18 years old, or you are using the website with the permission and supervision of a parent or legal guardian.

• The information you provide is accurate and current.

• You have read and accepted these Terms and our Privacy Policy.

2. Our products and services

EXASPERATION offers physical and digital products for families, including baby and toddler products, children’s clothing, maternity essentials, gifts and downloadable resources. We take reasonable care to ensure that product descriptions, photographs, prices and availability are accurate. However, colours and appearances may vary depending on your device, and minor errors may occasionally occur. We may update our products, prices and availability at any time. We may also limit quantities or discontinue a product where reasonably necessary.

3. Customer accounts

You may be asked to create an account to access certain features. If you create an account, you are responsible for:

• Providing accurate and current information.

• Keeping your login details secure.

• Notifying us if you believe your account has been accessed without permission.

You are responsible for activity conducted through your account unless the activity resulted from something within our reasonable control.

4. Orders and acceptance

Submitting an order does not guarantee its acceptance. An order is accepted when we send you confirmation that it has been processed.

We may reasonably refuse or cancel an order where:

• A product is unavailable.

• There is an obvious pricing or description error.

• Payment cannot be authorised.

• We suspect fraudulent or unauthorised activity.

• We are unable to fulfil the order.

If we cancel an order after payment has been received, we will issue a refund to the original payment method.

5. Pricing and payment

Unless otherwise stated, prices are displayed in Australian dollars. Delivery fees and any other applicable charges will be displayed before you complete your purchase. Payment must be made using one of the payment methods available at checkout. Payments are processed by third-party payment providers, and EXASPERATION does not store or have access to your complete payment-card details. Promotional offers, sale prices and discount codes may be subject to additional conditions and expiry dates.

6. Physical orders, delivery and local pickup

Processing and delivery timeframes are estimates and may be affected by busy periods, public holidays, postal delays or circumstances outside our reasonable control. Where tracking is available, tracking details will be provided after dispatch. Local pickup may be available from Collingwood Park, Queensland 4301. Please wait until we confirm that your order is ready before collecting it. Please refer to our Delivery & Return Policy for information about processing, delivery, tracking, local pickup and returns.

7. Digital products

Digital products are supplied electronically, and no physical item will be posted. After purchasing a digital product, you will receive instructions for accessing or downloading your files. You are responsible for providing a correct email address and checking your junk or spam folder.

Unless the product description states otherwise, your purchase provides a personal, non-exclusive and non-transferable licence to use the digital product.

You must not:

• Resell, share or redistribute the files.

• Upload the files to another website or platform.

• Reproduce the product for commercial purposes.

• Claim the content or design as your own.

Except where required by the Australian Consumer Law, change-of-mind refunds are generally unavailable once a digital product or download link has been supplied. Please contact us if a file is faulty, significantly different from its description or cannot be accessed.

8. Returns, refunds and exchanges

Returns, exchanges and change-of-mind requests are managed in accordance with our Delivery & Return Policy. Please contact us before returning an item. Eligibility may depend on the type of product, its condition and the reason for the return. Nothing in these Terms or our Delivery & Return Policy limits your rights under the Australian Consumer Law, including rights relating to faulty, unsafe or misdescribed products.

9. Damaged, faulty or incorrect orders

If your order arrives damaged, faulty or incorrect, please contact us as soon as reasonably possible.

Please include:

• Your order number.

• A description of the problem.

• Clear photographs of the item and its packaging, where applicable.

We will review the issue and provide an appropriate remedy in accordance with the Australian Consumer Law.

10. Intellectual property

The content on our website—including our branding, logos, text, graphics, photographs, illustrations, designs and digital products—is owned by EXASPERATION or used with permission. You must not copy, reproduce, modify, distribute, sell or commercially use this content without prior written permission, except where permitted by law or by a licence accompanying a purchased digital product.

11. Acceptable use

You must not:

• Use our website for an unlawful or fraudulent purpose.

• Attempt to interfere with the website’s security or operation.

• Introduce viruses, malicious code or harmful technology.

• Access another customer’s account without permission.

• Infringe another person’s intellectual-property or privacy rights.

We may restrict access where we reasonably believe these Terms have been seriously breached.
